CONDITIONS GENERALES DE VENTES

La présente location est établie aux conditions suivantes décrites ci-après, et que le preneur s’engage à respecter :

1. N’occuper les lieux que bourgeoisement, à l’exclusion de tout commerce ou profession, le preneur reconnaissant que la location ne lui est consentie que qu’à titre de résidence provisoire et de plaisance.

2. Occuper les lieux loués personnellement et ne pouvoir en aucun cas sous-louer, même gratuitement, ou céder ses droits à la présente location, sauf accord écrit du bailleur.

3. Ne faire aucune modification, ni changement dans la disposition des meubles et des lieux.

4. Le preneur ne pourra sous aucun prétexte introduire des animaux (chiens, chats, etc…) dans les lieux loués sans autorisation spéciale du bailleur. Un supplément de 30€ par réservation sera exigible dans ce cas.

5. Régler les niveaux sonores des appareils de radio, télévision et autres, de manière à ce que les voisins ne puissent être importunés. En cas de plainte, le preneur assumera toutes les réclamations présentées par les tierces personnes.

6. Aucune réclamation ne sera prise en compte au-delà de 24h après l’entrée dans le logement.

7. Ne rendre en aucun cas le bailleur responsable en cas de vol commis dans les lieux loués.

8. Entretenir les lieux loués et les rendre en bon état de réparations locatives et d’entretien en fin de jouissance.

9. Une caution de 400€ en espèces sera demandée au preneur dès son arrivée à l’agence, ou à défaut, un prélèvement de 400€ sera effectué sur sa carte bancaire. Les chèques ne sont pas acceptés. Cette caution lui sera restituée lors de son départ, ou créditée sur son compte bancaire si elle a été prélevée sur sa carte bancaire. Les éléments vérifiés dans le logement seront : le mobilier intérieur et extérieur, la télévision, ainsi que le reste de l’équipement du lieu loué. En cas de détérioration dans le logement, le montant des dommages sera directement prélevé sur la caution.

10. Le preneur ne pourra réclamer d’indemnité du fait de nuisances provoquées par d’éventuels travaux effectués aux alentours des lieux loués, ceux-ci faisant partie de circonstances imprévisibles ne pouvant engager la responsabilité du bailleur.

11. Si par suite de circonstances irrésistibles et imprévisibles, le bailleur ne peut mettre à disposition du preneur la location qu’il a louée, il s’oblige à mettre en œuvre tous les moyens dont il dispose pour procurer une location de confort et de capacité comparables à celle retenue. En cas d’impossibilité, le bailleur remboursera les sommes versées, à l’exclusion de toute indemnité.

12. Le preneur ne pourra adresser aucune réclamation, ni demande d’indemnité au bailleur au sujet de privation de jouissance d’une quelconque des sources d’énergie (eau, électricité, gaz, etc…) quelle qu’en soit la durée, si elle provient d’un chômage imposé par les services publics ou privés fournisseurs de ces énergies pour mettre les réseaux et appareils en bon état d’entretien ou pour faire des réparations, ou si encore l’arrêt est provoqué par une panne d’électricité, de fonctionnement ou d’approvisionnement.

13. La capacité maximum d’accueil d’occupants est signifiée dans la désignation des lieux loués et est expressément indiquée comme étant la totalité des occupants possibles, adultes et enfants compris. Les enfants de moins de 2 ans pourront être acceptés, sans charges ni suppléments. En cas d’occupation en surnombre dans le logement, sans en avoir avisé le bailleur, celui-ci se réserve le droit d’appliquer un supplément sur le prix de location.

14. Le montant de la location est indiqué toutes taxes comprises, excepté la taxe de séjour, de 0,50€ par personne âgée de plus de 16 ans, et par jour, applicable pour une période maximale d’une semaine.

15. Le forfait comprend : services de nettoyage de sortie, maintenance du jardin, eau, électricité, et autres services auxiliaires. Le rangement et le nettoyage de la cuisine en fin de séjour ainsi que le fait de jeter les poubelles ne sont pas inclus dans le forfait.

16. Jours d’entrée et de sortie : le samedi. Entrées et sorties : les arrivées se feront entre 16h et 20h et les départs de 7h à 10h maximum. Si le preneur ne peut se soumettre à ces horaires, il devra en aviser le bailleur par téléphone dans les meilleurs délais. Un supplément de 20€ sera appliqué pour les arrivées au-delà de 20h30, ainsi que pour les dimanches et jours fériés. En basse saison (d’octobre à mai), les jours d’arrivées peuvent être modifiés.

17. Conditions de paiement : 30% d’acompte à la réservation, et le reste 30 jours avant la date d’arrivée. Si après 5 jours de la date du 2ème acompte, le preneur ne prend pas contact avec l’agence, celle-ci se réserve le droit d’annuler la réservation.

18. Politique d’annulation : le preneur peut annuler la réservation quand il le souhaite, mais il se soumettra à une pénalisation : 50% de l’acompte versé lui sera remboursé s’il annule avec 2 mois de préavis, et 25% s’il annule avec 40 jours de préavis.

19. En cas de litige ou de réclamation, le preneur sera soumis aux Tribunaux de la province de Tarragone, en Espagne.
